Definitions

"Candidate" means a Website User who applies for a vacancy direct to a Potential Employer and/or a Website User who uses the Recruitment Services.

"Chat Rooms" means the online chat rooms provided on the Website.

"Company" means Compare Professional Service Jobs Limited, a company incorporated in England under company registration number 06908912, VAT registration number 974 0047 23 whose registered office is at The Old Grammar School, St. Leonard's Close, Bridgnorth, Shropshire WV16 4EJ.  Telephone number 0870 240 1010, email address: info@comparelegaljobs.com

"Content Standards" means the standards set out in Clause 7.

"Interactive Services" means the services set out in Clause 6.

"Job Board" means the job search facility found on the Website which enables Website Users to conduct a "search and compare" in respect of current job vacancies.

"Potential Employer" means an employer that advertises job vacancies via the Job Board with a view to offering employment.

"Recruitment Services" means the recruitment services provided by the Company as set out in Clause 2.

"Regulations" means the Conduct of Employment Agencies and Employment Business Regulations 2003 (as amended).

"We", "Us" or "Our" refers to the Company.

"Website" means the website found at www.comparelegaljobs.com including the Job Board and Chat Rooms which is owned and operated by the Company.

"Website User" means those persons accessing the Website;

"You" or "Your" refers to the Website User.

NOTE : CERTAIN CLAUSES WITHIN THESE TERMS AND CONDITIONS APPLY TO ALL WEBSITE USERS REGARDLESS OF WHETHER OR NOT A JOB APPLICATION IS MADE BY THE WEBSITE USER


Please note that by accessing the Website and/or using the Recruitment Services you are confirming your acceptance of these Terms and Conditions.  We reserve the right, at our sole discretion, to alter, change, modify, add, or delete portions of these Terms and Conditions and/or the Website at any time without notifying you in advance. If we do so in respect of the Terms and Conditions we will detail the changes made on this page giving the date the Terms and Conditions were last revised. If you continue to use the Website after any such changes you will be deemed to have accepted the new version of the Terms and Conditions. It is your responsibility to regularly check the Website to determine if there have been changes to these Terms and Conditions and to review such changes.

If we wish to vary the terms of the Recruitment Services we will contact you via email to obtain your approval.

1.       The Job Board & Direct Approaches

The Job Board identifies current job vacancies which you may apply for either directly (a "Direct Approach") or via our Recruitment Advisors (see Clause 2 below).

Any screening or search tools provided on the Website for use in your assessment of a vacancy are for your assistance only.  They are not a substitute for carrying out your own checks.

If you choose to make a Direct Approach to a Potential Employer you should note that we do not carry out the same level of enquiries as when a Candidate is put forward for a vacancy through our Recruitment Services.  Furthermore, the Regulations are not applicable to Direct Approaches as we are simply supplying you with information rather than acting as an "employment agency".

We recommend that Candidates check their own suitability for any positions advertised on the Job Board when making a Direct Approach.  The Regulations set out a number of steps you can take to assist you in this.  You could check the identity of the Potential Employer, what its business is, when the position starts and how long it lasts, what the position involves, i.e. hours, location, type of work, experience required, training given, any qualifications or permits required and any legal requirements imposed on you before you can take up the position.

2.       Recruitment Services

In addition to providing the Job Board we also act as an "employment agency" for the purposes of the Regulations.  That means that we seek work for Candidates with a view to securing them direct employment or engagement with Potential Employers.  We specialise in recruitment services within the legal sector.

The Recruitment Services are provided free of charge to Candidates.

Upon registration we will need confirmation of your identity, e.g. sight of your passport, driving licence or birth certificate.  We will also require confirmation that you have the experience, training, qualifications and any authorisation which we deem necessary, or which you need to have by law or by the requirements of any professional body, in order to work in the relevant position.

We will therefore require you to provide i) copy documentation relating to all relevant qualifications or authorisations that you need to work in the relevant position; ii) two written references from persons not related to you (ensuring where those persons have agreed that we can disclose their references to a Potential Employer) and iii) confirmation that you are not unsuitable to work with vulnerable persons.

From time to time we shall, at our sole discretion, search the Job Board for job vacancies for you.  If we identify an appropriate vacancy we shall inform you of this opportunity and the relevant terms of employment.

We may arrange an interview for you so that you can meet the Potential Employer and discuss your suitability further.  We may also offer to assist you in concluding negotiations with the Potential Employer.  However, we do not guarantee that any pursuit of a job vacancy shall lead to a job offer.

Prior to approaching a Potential Employer we will always seek your express permission to ensure that you are willing to fulfil the relevant role.  However, if you do not wish us to approach certain employers please inform us in writing of the relevant organisations.

3.       Your Online Account

If you wish to apply for a job vacancy via the Job Board and/or use the Recruitment Services, you will need to set up an online account with us.  The procedure for setting up the account is set out on the registration page of the Website.

You shall be responsible for the use of your account and for any activity which takes place on the account.  You should therefore ensure that your account log-in details (including user name and password) are kept confidential at all times.  Do not disclose these details to a third party (knowingly or unknowingly).  In the event that log-in details for your account are revealed to a third party you should notify us immediately.

4.       Conditions Of Use For The Website

Your use of the Website means that you accept, and agree to abide by, these Terms and Conditions.  You may also find that they contain some useful advice on how to get the most out of our Recruitment Services and the Website.

In consideration of agreeing to your use of the Website, you acknowledge that the ownership in any intellectual property rights (including, for the avoidance of doubt, copyright) in the Website belongs to us.  Accordingly, any part of the Website (or its source HTML code) may not be used, transferred, copied or reproduced in whole or in part in any manner other than for the purposes of utilising the Website meaning that you may only display it on your computer screen and print it out on your printer for the sole purpose of viewing its content.

You may only use the trademarks featured in the Website for the purpose of displaying the Website on your computer screen or printing out the Website on your printer.

You may not link the Website to any other website.  Furthermore, we do not make any warranties, representations or undertakings about the content of any other website which may be referred to or accessed by hypertext link with the Website, and we do not endorse or approve the content of such third party websites.

There are several places throughout comparelegaljobs.com that may link to other websites that do not operate under comparelegaljobs.com privacy practices. When you link to other websites, CompareLegalJobs privacy practices no longer apply. We encourage visitors to review each site's privacy policy before disclosing any personally identifiable information.

Some of comparelegaljobs.com publications are listed under www.amazon.com in order to make it easier for visitors to purchase books online. Visitors may search comparelegaljobs.com list of publications and then click a link to connect to the amazon website to make a purchase. The only information passed to the amazon website is the publication that has been selected. 

Please be aware that to the extent permitted by law and except as expressly provided for herein we do not accept liability in respect of the Website or your use of it.  The Company is not responsible for the accuracy of any information published by any other company or organisation including but not limited to Potential Employers.

5.       Prohibited Uses of the Website

You may use the Website only for lawful purposes.  You may not use the Website:

In any way that breaches any applicable local, national or international law or regulation.

In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.

To send, knowingly receive, upload, download, use or re-use any material which does not comply with our Content Standards as set out in Clause 7.

To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any form of similar solicitation (spam).

To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programmes or similar computer code designed to adversely affect the operation of any computer software of hardware.

You also agree:

Not to reproduce, duplicate, copy or re-sell any part of the Website in contravention of the provisions of these Terms and Conditions.

Not to access without authority, interfere with, damage or disrupt:

Any part of the Website; or

Any equipment or network on which the Website is stored; or

Any software used in the provision of the Website.

6.       Interactive Services

We may from time to time provide Interactive Services on the Website, including, without limitation:

When we provide Interactive Services, we will provide clear information to you about the kind of service offered, if it is moderated and what form of moderation is used (including whether it is human or technical).

We will do our best to assess any possible risks for Website Users and/or Candidates from third parties when they use any Interactive Services on the Website.  However, we are under no obligation to oversee, monitor or moderate any Interactive Services we provide on the Website, and we expressly exclude our liability for any loss or damage arising from use of the Interactive Services by Website Users and/or Candidates in contravention of content standards, whether the service is moderated or not.

7.       Content Standards

These Content Standards apply to any and all material which you contribute to the Website or include in any message ("Contributions") and to any Interactive Services associated with it.

You must comply with the spirit of the following standards as well as the letter.  The Content Standards apply to each part of any contribution as well as to its whole.

Contributions must:

Be accurate (where they state facts);

Be genuinely held (where they state opinions);

Comply with applicable law in the United Kingdom and any country from which they are posted;

Be owned by you (or that you have permission to post such information and/or materials).

Contributions must not:

Contain any material which is defamatory of any person, obscene, offensive, hateful or inflammatory;

Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;

Infringe any intellectual property rights (including but not limited to copyright, database right or trade mark) of any other person;

Be likely to deceive any person;

Be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence;

Promote any illegal activity;

Be threatening, abusive or invade another's privacy, or cause annoyance, inconvenience or needless anxiety;

Be likely to harass, upset, embarrass, alarm or annoy any other person;

Give the impression that they emanate from us, if this is not the case;

Advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.

You agree to fully indemnify us in respect of any liabilities, losses, expenses or other costs whatsoever incurred as a direct or indirect result of a  breach of your obligations under this clause 7, including, but not limited to, any claims made against us by any third party.

8.       Our Warranties And Liability

In so far as the law allows, we shall not be liable for any loss or damage (direct or indirect) caused to you by use of the Recruitment Services and/or the Website.  Your sole remedy (and our entire financial liability to you) in respect of any such loss or damage shall be to discontinue use of the Recruitment Services and/or the Website.

We cannot guarantee that your applications will lead to a job offer and we do not accept any liability if we do not find work for you nor do we warrant that certain vacancies are suitable for you.

You acknowledge and accept that a Potential Employer may withdraw an opportunity at any time prior to you having a formal contract in place with it.  We cannot guarantee accuracy of Potential Employer's information.

For the avoidance of doubt we shall not be responsible for any issues that may arise if you download software from an external third party website or upgrade your browser software to enhance your usage of the Website.  Furthermore we do not control and are not responsible for what other users post or transmit on the Website and any reference to products, services or reputations does not constitute or imply our endorsement or recommendation of the same.

We shall make reasonable endeavours to make the Website available to you.  However, you acknowledge and accept that by its nature internet based technology is insecure and uninterrupted service cannot be guaranteed.  You further acknowledge and accept that from time to time it will be necessary for us to carry out necessary maintenance in respect of the Website resulting in occasional periods of downtime.  Although we will use reasonable endeavours to minimise such downtime periods we make no representations or warranties to you in respect of the availability of the Recruitment Services and/or the Website.

Nothing contained in this clause 8 excludes or limits the Company's liability for death or personal injury caused by the Company's negligence, or for fraud or fraudulent misrepresentation.

You agree that the limitation of liability contained in this clause 8 is reasonable in all the circumstances.

9.       Your Warranties And Liability

You represent and warrant that you are 18 years old or above.

You consent to our retention of your information to enable us to comply with our statutory obligations.

You shall, at all times, comply with the Terms and Conditions and will only utilise the Website for the purposes anticipated by these Terms and Conditions.

You warrant that all information you provide to us is full, accurate and complete in all material respects and that we are entitled to and shall rely upon such information including but not limited to information you provide to us which is relevant to a Potential Employer's decision as to whether you engage you, whether relating to your health or ability to perform work efficiently or otherwise, together with details of any periods of sickness you may have taken during the previous twelve months and whether such sickness or any matter relating to it may be likely to reoccur.

You warrant that any references which we may request from you shall be provided by non-relatives.

You will at all times and on demand fully indemnify us and keep us fully indemnified from and against any claims, threatened or made against us arising as a direct or indirect result of your non-compliance with any of your representations, warranties or obligations set out in these Terms and Conditions.

10.     Should You Have A Complaint

If you experience problems in respect of the Recruitment Services and/or the Website you should refer your complaint to either Tim Bates (at tim.bates@comparelegaljobs.com) or Charles Magill (at charlesmagill@comparelegaljobs.com), who will use reasonable endeavours to resolve the problem as soon as possible.

11.     Use Of Your Data And Privacy Policy

The Data Protection Act 1998 is designed to protect individuals about whom information is entered and stored on computers and other systems.  Accordingly, it lays down strict standards of accuracy, relevance and care of such data including how it may be divulged.  Any data about individuals you enter onto the Website directly or include in any message to us will be subject to the Data Protection Act 1998.  You are therefore responsible for its accuracy and relevance.  You must have the authority to disclose it and for us to utilise it for the purposes of any transaction concluded for or by you through the Website.  If you are in any doubt about any data please feel free to email Tim Bates (our Data Controller) at tim.bates@comparelegaljobs.com, with details of the problem first.

We will collate the information which you give to us in the online registration form to provide you with the Recruitment Services.  By giving us this information, you consent to our use of it in order to process your application and provide the Recruitment Services.  It will be necessary to forward your data to certain third parties in order for us to provide the Recruitment Services and by accepting these Terms and Conditions you are giving us your approval to forward your data to such third parties as we deem necessary in order for us to do so.  If you notify us in writing that you do not wish to receive emails from us then we shall ensure that we do not do so but we cannot guarantee that that third parties to whom your data is sent will not do so.  It is your responsibility to advise them directly if you wish to stop any such emailing activity.

12.     Termination

We reserve the right to permanently take down the Website and withdraw the Recruitment Services upon providing you with five (5) days written notice.

We may terminate your online account and the provision of the Recruitment Services (in whole or in part) immediately if you are in breach of any of these Terms and Conditions.  Furthermore we may withdraw our Recruitment Services immediately in the event that our agreement with a particular Employer terminates for any reason whatsoever.

If you wish to terminate your online account and the provision of Recruitment Services you shall provide us with five (5) days prior written notice.  In such circumstances, please contact Tim Bates via email at tim.bates@comparelegaljobs.com entitling your email "Cancellation of Account".  We will cancel your account as soon as reasonably practicable.

13.     Force Majeure

We shall not be liable for any delay or failure in providing the Recruitment Services and/or the Website which results directly or indirectly from acts of nature, forces or causes beyond its reasonable control including but not limited to technology failure, power failures, strikes, labour disputes, riots, terrorism, insurrections, civil disturbances, vandalism, fires, floods, storms, explosions, acts of God, war, governmental actions or orders of court.

14.     General

14.1        Any reference to the singular includes the plural and vice versa, and reference to a gender includes the other genders unless the context requires otherwise.  Reference to a "person" includes any individual, firm, unincorporated association or body corporate.

14.2        The headings in this Agreement are for convenience only and shall not effect its interpretation.

14.3        These Terms and Conditions constitute the entire agreement between us and supersede all prior agreements, arrangements or understandings (both oral and written) between us relating to the subject matter of this Agreement.  If any provision of this Agreement is held by any court or other competent authority, to be void or unenforceable in whole or part, this Agreement shall continue to be valid as to the other provisions thereof and the remainder of the affected provision.

14.4        A person who is not party to this Agreement shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this Agreement.  This clause does not affect any right or remedy of any person which exists or is available otherwise than pursuant to that Act.

14.5        The contract governed by English Law.  Both parties agree to submit to the non-exclusive jurisdiction of the English Courts.
